Overview

Field facts for workers' compensation and medical claims

A workers' compensation claim is evaluated largely on paper: the first report of injury, medical records, bills and restrictions. Questions arise when the paper does not fit what the employer or adjuster knows. The injury was unwitnessed. The reported activity level does not match what a supervisor saw. A clinic is billing for a volume of visits that seems implausible. Answering those questions takes someone on the ground.

Delator Claims Division provides that field capability across Tennessee: documenting the injury scene as found, interviewing coworkers who are willing to speak, observing a claimant's public activity, verifying outside employment through observation and public records, and confirming that a medical provider operates where and when its billing says it does. These services are available to carriers, self-insured employers, administrators and their attorneys only.

How a deployment runs

From request to delivered record

  2. DeployDispatch assigns the nearest available licensed field investigator through the statewide network.
  3. DocumentPhotographs, video, measurements and factual notes are captured once the scene is safe to work.
  4. PreserveFiles are timestamped, organized and kept in their original form with a record of who captured them.
  5. ReportThe package is delivered securely to the requesting party, typically the same day.
In practice

Limits that keep the work usable

Surveillance is conducted from public vantage points and documents activity with dated video and a factual log. Investigators do not contact the claimant during surveillance and do not offer medical opinions about what an activity means. Interpretation is left to the carrier and the treating or reviewing physicians.

On medical and billing matters Delator verifies facts in the field. It does not audit medical records or billing codes, does not obtain protected health information without proper authorization, and does not conclude that a provider or claimant committed fraud.

Scope of workCarrier-side service

This service is available to insurance carriers, self-insured entities, third-party administrators and the attorneys who represent them. Delator reports facts and observed indicators; decisions on coverage, liability, settlement and any fraud referral remain with the client.

It is not offered to policyholders or claimants, and Delator does not act as a public adjuster. Policyholders and claimants can request neutral scene documentation instead.

Questions

Common questions

Who can request these investigations?

Workers' compensation carriers, self-insured employers, third-party administrators and attorneys representing them. They are not offered to injured workers or their representatives.

Do you decide whether a claim is fraudulent?

No. Delator reports facts and indicators. Any conclusion about fraud, and any referral, is made by the client or the authorities.

Is surveillance legal in Tennessee?

Delator's licensed investigators observe and record only what is visible from public places, without trespass or pretext. Clients with questions about how surveillance material may be used should consult their counsel.

Can you cover a claimant who lives in a rural county?

Yes. All 95 Tennessee counties are covered through the same dispatch network, with assignments scheduled around the claimant's known routine.
